The following Terms of Service ("Terms") apply when using the https://payscope.io website, and related sites, apps, communications, and services ("Services") operated by Payscope LLC ("us", "we", or "our").
These Terms govern your access to and use of the Services, and apply to visitors, registered users, and any others.
By accessing or using the Service you agree to be bound by these Terms. You may not access or use the Service if you are unwilling or unable to be bound by the Terms.
Our Services shall be used in good faith for the purpose of fairly identifying compensation budget limitation prior to interviewing, in order to save for all parties the time and effort for consideration without the loss of negotiation position. It shall not be used with the intent of determining the lowest amount a candidate would accept, nor with the intent of determining an employer's budget.
As such, the following practices (including by not limited to) are forbidden: (i) setting a budget lower than actual for the purpose of discovering compensation requirements rather than for the interest of saving time; (ii) asking a candidate to respond to multiple surveys with the intention of determining compensation range; (iii) using multiple accounts whether owned individually or in groups to either create or respond to surveys for the purpose of compensation data collection; and (iv) creating or responding to surveys without the intent of proceeding to interviews with the other party.
When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.
You are responsible for maintaining the confidentiality of your account, and passwords for your email and/or a third-party service. You agree to accept responsibility for any and all activities or actions that occur under your account and/or email, and restrict access to your computer, email, and/or third party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You must use your legal name, and an email and/or third party sign-on that belongs to you. Employer accounts must use the name or trademark of the entity they represent, or another entity with appropriate authorization.
We reserve the right to refuse service, freeze or terminate accounts, and remove or edit content in our sole discretion.
By creating an account on our services, you agree to subscribe to email communications that we may send. You may opt out of receiving any newsletters, marketing or promotional materials from us by changing your account settings or by following the unsubscribe link or instructions provided in any email we send. However, you cannot opt out of receiving certain administrative, transactional, or legal messages from us.
Our Services allow you to post, link, store, share and otherwise make available certain information, text, graphics, or other material ("Content"). You are responsible for the Content that you post on or through the Services, including its legality, reliability, and appropriateness.
By posting Content on or through the Services, you represent and warrant that: (i) you have the right to use the Content and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. We reserve the right to terminate the account of anyone found to be infringing on a copyright.
You retain any and all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights. We take no responsibility and assume no liability for Content you or any third party posts on or through the Service. However, by posting Content using the Service you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. We reserve the right but not the obligation to monitor and edit or remove all Content provided by users.
We may use the Content you provide for automatic processing, such as determining and displaying related job posts.
Content found on or through the Services belong to Payscope LLC or are used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.
Our Service may contain links to third party web sites or services that are not owned or controlled by us. Payscope LLC has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.
You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services.
Third party web sites or services shall be subject to their respective terms and conditions and privacy policies.
The Services and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Payscope LLC.
Payscope, and “PS” logos and other Payscope trademarks, service marks, graphics and logos used for our Services are trademarks or registered trademarks of Payscope. Our trademarks and trade dress may not be used in connection with another product or service without the prior written consent.
Trademarks and logos used in connection with the Services are the trademarks of their respective owners.
You agree to defend, indemnify and hold harmless Payscope LLC and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of (i) your use and access of the Services, by you or any person using your account and password; (ii)) a breach of these Terms; or (iii) Content posted on the Service.
In no event shall Payscope LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, differences in negotiated companesation, cessation of recruiting, loss of profits, data, use, goodwill and/or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Your use of the Services are at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
Payscope LLC, its subsidiaries, affiliates, and its licensors do not warrant that a) the Services will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Services are free of viruses or other harmful components; or d) the results of using the Services will meet your requirements.
Some parts of the Service are billed on a subscription basis. If you buy any of our paid Services, you agree to pay us the applicable fees and taxes and to additional terms specific to the paid Services. Failure to pay these fees will result in the termination of your paid Services.
You will be billed in advance on a recurring and periodic basis. Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a subscription. At the end of each billing cycle, your subscription will automatically renew under the exact same conditions unless you cancel it or it is cancelled by us.
We may modify the fee for subscriptions at any time under our sole discretion. Any subscription fee change would become effective at the start of your next billing cycle.
We will provide reasonable notice prior to any fee changes to allow you the opportunity to cancel your subscription prior to the changes. Your continued use of the Services after a subscription fee change comes into effect constitutes your agreement to pay the modified subscription fee amount.
Except as required by law, payments are non-refundable, including fees and other charges.
Refunds for recent subscriptions, made in error, may be considered on a case-by-case basis and granted in our sole discretion.
You may terminate the Terms at any time by deleting your Account. Account deletion will result in immediate deletion of your personal information and your survey, job post, and response data.
We may close your Account, suspend your ability to use certain portions of the Service, terminate any license or permission granted to you hereunder, and/or ban you altogether from the Service for any or no reason, and without notice or liability of any kind. Any such action could prevent you from accessing your account, the Services, your content, Services Content, or any other related information.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
By sending us any ideas, suggestions, documents or proposals (“Feedback”), you agree that (i) your Feedback does not contain any third party confidential or proprietary information; (ii) we are under no obligation of confidentiality, express or implied, with respect to the Feedback; (iii) we may have something similar to the Feedback already under consideration or in development; (iv) we have no obligation to review, consider, or implement the Feedback, or to return to you all or part of the Feedback; and (v) you grant us an irrevocable, non-exclusive, royalty-free, perpetual, worldwide, assignable, sublicensable, transferable license to use, modify, prepare derivative works of, publish, distribute and sublicense the Feedback, and you irrevocably waive, and cause to be waived, against Payscope and its users any claims and assertions of any moral rights contained in such Feedback.
The laws of the State of California, U.S.A., excluding its conflict of laws rules, shall exclusively govern any dispute relating to these Terms and/or the Services. All claims and disputes can be litigated only in the federal or state courts in Santa Clara County, California, USA, and you agree to personal jurisdiction in those courts.
We may modify these Terms and our Privacy Policy from time to time. If we make material changes to it, we will provide you notice through our Services, or by other means, to provide you the opportunity to review the changes before they become effective. We agree that changes cannot be retroactive.
By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you may delete your account.
